Capacity Primacy The governance logic of the AI era: control of computational capacity conditions which rules can be made effective and who can set the technical defaults that become embedded throughout the stack. Introduced as a complement to classical rule primacy, not a replacement. Part V
Categorical Gap The structural mismatch between legal categories designed for deterministic, territorial, human-driven activity and AI systems that are none of these things — producing a thinning of meaning in which legal classifications cannot attach cleanly to technical realities. Part II
Cognitive Disenfranchisement The systematic exclusion of a society's norms, harms, and institutional patterns from the decision outcomes of AI models — arising from the absence of that society's data in training corpora. Part V
Compliance Cascade A chain of secondary obligations that firms must satisfy together to maintain market access — impact assessments, disclosure procedures, consent management, localisation requirements, and audit documentation that cluster into bundles and become embedded in product design. Compliance Gridlock The condition in which incompatible commands from multiple sovereigns must all be obeyed but none can be reconciled by the states that issued them. Part I, Ch. 2
Data Port An emerging institutional form in which cross-sovereign computation occurs within a jurisdiction capable of hosting it physically, legally, and infrastructurally. Part IV

Gateway Rule A regulatory requirement whose compliance forces changes to foundational system design — data schemas, reporting formats, documentation pipelines, network configurations, or contractual defaults — causing effects that propagate across borders via system design rather than formal national adoption. Extends the Incorporation Heuristic by isolating the mechanism of cross-border regulatory reach. Part IV
Golden Image A preconfigured compliance baseline — master service agreements, audit protocols, data-protection addenda, cross-border transfer mechanisms — replicated across deployments by professional services firms to ensure consistency and reduce configuration risk. Measurement Gap The rupture that forms when industrial-era accounting frameworks confront probabilistic, self-updating capital — limiting the State's capacity to price AI's contribution even when it can regulate AI's conduct. Part II
Misleading Dashboard Effect The condition in which monitoring tools continue to signal compliance and control even as actual system behaviour moves beyond institutional reach — surface indicators remain calm while underlying misalignment deepens. Part V
Obsolescence Trap The dynamic in which a rule designed for one model generation arrives just in time to regulate the one that no longer exists — by the time a rule is drafted, the practice has evolved; by the time it is enforced, the system design has changed; by the time it is revised, the field has moved again. Parametric Democracy A governance mechanism proposed in this manuscript that preserves democratic legitimacy by shifting regulation from rule authorship to constraint calibration — citizens vote on the trade-offs that executable systems must respect rather than on the executable logic itself. Protocol of Federation An institutional mechanism proposed in this manuscript for managing legal pluralism at the machine interface — enabling interaction between incompatible normative systems without demanding alignment of their internal values. Nations need not agree on the meaning of liberty, privacy, order, or rights; they need only maintain protocol-level interoperability. Part V

Root Access / Admin Access / User Access The three tiers of the Topology of Power. Root-access states write the defaults that propagate globally. Rule-Execution Gap The structural separation between the declaration of a rule and its realisation inside the systems meant to execute it — the distance a rule must travel from legislative intent to technical implementation. Part I
Sovereign API An institutional interface specification defining the channels through which democratically legitimate authority shapes machine-executed outcomes. On the input side, it receives statutes, regulations, and obligations; on the output side, it renders them as constraint schemas, parameter ranges, prohibited and required behaviours, and documentation requirements that technical systems can consume. Not a technical instrument but a constitutional one. Part V
Sovereignty Paradox The condition in which the political map recognises nearly two hundred sovereign states while the AI economy organises itself around a far smaller number of regulatory gravity centres whose rules propagate unevenly through global systems. Part IV

Translation Layer The distributed ecosystem of legal, accounting, technical, and assurance institutions — principally Big Law and the Big Four accounting networks — that operates between statutes and code, converting governance principles into executable protocols.
